Elton Guliyev, the lawyer of former Minister of the Foreign Economic Relations (MFER), Nijat Guliyev, made a statement in connection with false information in the media allegedly citing the arrest of his client. According to the lawyer, on August 7, at about 7:00, Nijat Guliyev came out of his home in the village of Novkhani, and went to the nearby store of household goods.
Several people came after him into the store, did not introduce any documents and without clarification, seized Guliyev and handcuffed him. They put N.Guliyev to the back seat of his car, and drove to the administrative building of the Ministry of National Security (MNS).
N. Guliyev was not allowed to enter his home to change clothes or tell relatives about being detained.
After 4 or 5 hour,s at around 23:30 about 20 employees of the MNS, knowing that there were only Guliyev’s wife and teenage daughters at home, jumped over the fence and into the yard of Guliyev’s house. Most of them were masked and armed. Guliyev's wife was not able to control the actions of those people. The masked gunmen took away mobile phones of family members, and were forbidden to leave the house. The search was conducted without any need from 23:30 to 7:00 am.
Not explaining what they were looking for, they seized documents, computers belonging to the private life of N.Guliyev and his family, photo and video materials and a metal safe.
Guliyev’s wife said that there have never been arms in their home and she herself cleaned the utility room two days ago , where allegedly arms were found. N.Guliyev’s wife noted it in the minutes.
During the search, none of the family members at home could control the actions of people searching in the yard.
N.Guliyev, immediately after his arrest, asked for a lawyer and a chance to call home. However, his demands were ignored. A few hours later, he was told that a gun and ammunition were found in his car. However N.Guliyev denied the allegations. Guliyev’s participation in the search of his car was not provided.
After the detention, the car was out of his control, and was searched by the employees of the Ministry of National Security.
Based on weapons and ammunition supposedly found in the car, a lawsuit was filed against N.Guliyev under Article 228.1 (illegal possession of firearms and ammunition.) Although, in accordance with Article 215.5 of the Criminal Code, and subparagraph 1 of paragraph 3 of the Decree of President of Azerbaijan N387 of August 25, 2000, the preliminary investigation of the said article shall be conducted by the police.
Thus, the decision to start the lawsuit was made by an official body, who are not entitled to do so.
The next morning N.Guliyev learned from the text of the accusation against him that supposedly at his dacha were found automatic weapons, hand grenades and other ammunition.
Guliyev refused to testify because the charges were fabricated. However, he was taken to the Sabail District Court, in the course of the formal trial against him and he was arrested for a period of two months.

Guliyev worked as the Minister of Foreign Economic Relations (MFER) 1993-95. Later he went to Adjaria, where he was an advisor of the president Aslan Abashidze, until his resignation in 2004. After that, he returned to Azerbaijan and did business in Azerbaijan and Turkey.
Guliyev was not involved in any political, social or other public activities.
In October 2005, Guliyev, was arrested along with a group of high-ranking officials on charges of attempting a coup. However, two weeks later, he was released, and was not brought to justice again.–06D—
