Kh.Ismaylova does not divulged state secret, expert
The assertions of the General Prosecutor Office that the journalist Khadija Ismaylova divulged state secrets is unfounded, said Doctor of Laws, professor KHanlar Alekperov.
"In the material published by Khadija Ismailova there is no personalized information (i.e. specific data on recruit paid agents,) and in such situation this is legally determining factor. Therefore the material does not carry a state secret. As for the information about a specific employee of the Ministry of National Security of the Azerbaijan Republic, who on the basis of compromising material recruited some members of the opposition as a paid agent , it can not be regarded as disclosure of information constituting a state secret," said the professor.
"Recruitment of the agent by operational search bodies (including intelligence,) specific methods and tools such recruitment (including by means of compromising material), etc. , do not constitute a state secret . In the open press, there are hundreds of thousands of available print and electronic literature, videotapes , etc., which are described in full details ( and are shown), almost all the existing tools of intelligence operative search activities and special intelligence agencies of the state.
If we talk about criminal liability for disclosure of information constituting a state secret, then in this case it applies only to a person who gave the analyzed document to Khadija Ismailova, said Alekperov. -02В-
