The Court of Appeal tightened the punishment for the Nardaran case figurant
Baku/07.04.18/Turan: The Baku Court of Appeal upheld the conviction of the "Nardaran case-3". The punishment for the theologian Zulfugar Mikailov was toughened from "strictly" to "special" regime.
It is noteworthy that the court of first instance ruled to serve a sentence in a strict regime jail, but in the verdict it was written about concluding a special regime. On 7 April, this violation was appealed by the Baku Court of Appeal at the request of Shahla Humbatova. Judge Sahibkhan Mirzoyev overturned the decision to keep Mikailov under a special regime. However, today, the same judge made a decision on keeping Mikayilov under a special regime.
Shahla Humbatova's lawyer called this illegal. For if there is no protest of the prosecutor and the complaint of the injured party, then the punishment cannot be aggravated. The defense will file a cassation appeal. It should be noted that Mikailov was sentenced to 17 years in prison.
The defendants in this case were arrested after a special operation in the village of Nardaran on November 26, 2015, when the police detained the leader of the movement "Muslim Unity" Tale Bagirzade and a group of his associates.
The arrested were accused of participating in a criminal community organized by Bagirzade. They were charged with ten Articles of the Criminal Code: terrorism, illegal possession of weapons, an attempt at violent change of the constitutional order, resistance to the police,
The defendants pleaded not guilty and told the court about the torture that they had been subjected to in the Main Directorate for Combating Organized Crime of the Moscow Patriotic War.
On December 6, 2017, the Baku Serious Crimes Court sentenced the theologian Zulfugar Mikayilov to 17 years in prison, Ruzi Ismayilov and Jabir Aliyev - each to 16 years, Ramil Seyfullaev, Mubariz Ibrahimov - each to 15 years, Elkhan Hasanov - to 14 years, Faig Allahverdiyev, Mehman Guliyev, Elman Agayev, - each to 13 years, Ali Huseynov, Mehman Mammadov, Eldar Bunyatov - each to 12 years and 3 months of imprisonment. -06D--
